Name of the Course: Moral Rights of the Author: A Comparative Approach in
IP Law
Instructor: Dr. Basak Bak
*Please note that the course is
given in Turkish. However, a good command of English is required to follow up
the course material.
This is a postgraduate taught course (LLM) in the curriculum
of the Ankara University Social Sciences Institute’s LL.M Program on
Intellectual Property Rights, Technological Policies and Innovation. The program is the first LL.M Program on
Intellectual Property Rights in Turkey and offered by Ankara University Intellectual
and Industrial Rights Research and Application Center (FISAUM). The center has
been a permanent observer at WIPO since 2012, and is now launching an LLM in Intellectual
Property Law program offered jointly with the WIPO Academy.
Course Description:
This course examines the moral rights of the author
within the framework of international regulations. For this purpose, the course
focuses on Bern Convention for the Protection of Literary and Artistic Works, Law
on Intellectual and Artistic Work of Turkey numbered 5846 (FSEK), German Act on
Copyright and Related Rights (Gesetz über Urheberrecht und verwandte Schutzrechte-UrhG),
French Intellectual Property Code (Code de la propriété intellectuelle), Swiss Federal
Act of October 9, 1992 on Copyright and Related Rights (Bundesgesetz über das
Urheberrecht und verwandte Schutzrechte-URG), Copyright, Designs and Patents Act
1988 (CDPA), Copyright Act (R.S.C., 1985, c. C-42) of Canada and VARA. The
course is designed as a comparative analysis of common law and civil law
traditions in terms of moral rights of the author and inquires whether there is
a dichotomy in their approaches to moral rights.

Sözleşmesi’ni kabul ettiğinde (1989) isteksizce de olsa manevi haklara ilişkin
düzenlemeler yapmak zorunda kaldı. Amerika’daki korumaya “Patchwork Protection” deniyor. Hem federal bir yasa
olarak VARA var. Hem de bazı federe devletlerin yasaları var (Kaliforniya, New
York gibi). VARA eser sahibinin manevi haklarını düzenlemektedir; ancak
getirdiği koruma yalnızca görsel sanatlar (visual arts) bakımındandır.
